
Tennessee just expanded its definition of vapor products and consumable materials to explicitly include nicotine analogues under HB 2359, effective immediately.
The legislation brings nicotine analogue formulations under the same taxation, regulation, and enforcement framework as traditional nicotine vapor products, and strengthens age-verification enforcement at the retail level. This kind of regulatory "reform" - focused on clarity and specification - is a critical step in closing loopholes and gaps in the regulatory environment. Through this legislation, it appears that Tennessee policymakers are acutely aware of the ever-evolving nicotine and tobacco market and want to ensure the products reaching their consumers have been properly evaluated by FDA and deemed for U.S. marketing authorization.
ARAC supports legislation that closes definitional gaps and ensures that all consumer products are adequately tested. Science-based regulation protects consumers and creates a more predictable pathway for manufacturers doing the work to meet rigorous standards. We look forward to continuously supporting manufacturers and sponsors who engage in creative product development strategies while also pursuing human subjects research necessary to support proper regulatory review and marketing.
